Federal rules: CARES Act, subsidized housing and fair housing

The 30-day notice for covered properties, Section 8 and public housing rules, and the Fair Housing Act.

CARES Act 30-day notice

For “covered dwellings” — properties with a federally backed mortgage (Fannie Mae, Freddie Mac, FHA, VA, USDA) or in a federal housing program — federal law (15 U.S.C. § 9058(c)) requires a 30-day notice to vacate for non-payment of rent. Courts disagree about exactly how it applies, so many landlords with covered properties give 30 days.

Subsidized housing

Public housing, Housing Choice Vouchers (Section 8), project-based Section 8 and tax-credit (LIHTC) properties have program rules on notices and good cause. Check the lease addendum and the HAP contract, and notify the housing authority where required.

Fair housing

The Fair Housing Act prohibits evictions based on race, color, religion, sex, national origin, familial status or disability, and requires reasonable accommodations for tenants with disabilities. Many states and cities protect additional traits, such as source of income.
